2. Our Courses

NauticSense Learning provides online maritime learning designed to support awareness, reflection, operational readiness, safer decision-making, and professional development.

Our courses are intended to help learners think more clearly about human performance, early warning signs, operational readiness, communication, assumptions, verification, and safer preparation before work begins.

Our courses are not a substitute for:

  • company procedures;
  • safety management systems;
  • risk assessments;
  • method statements;
  • toolbox talks;
  • statutory training;
  • vessel-specific instructions;
  • employer instructions;
  • legal or regulatory requirements;
  • professional judgement;
  • task-specific competence assessment.

Learners remain responsible for following their employer’s procedures, site requirements, vessel requirements, training requirements, and applicable laws and regulations.

Employers remain responsible for determining whether a learner is competent, authorised, and suitable to perform a particular role, task, operation, or vessel-based activity.

3. Account Creation

To access a course, you may need to create a user account.

You agree to provide accurate information when creating your account, including your name and email address. You are responsible for keeping your login details secure.

You must not share your account access with another person unless NauticSense Learning has given written permission.

We may suspend or remove access if we reasonably believe that an account has been shared, misused, used fraudulently, or used in breach of these Terms.

4. Course Access

When you purchase or are enrolled in a course, you receive access to the course for personal learning, internal professional development, or agreed organisational training purposes only.

Unless otherwise stated, access is provided to the individual learner named on the account.

You must not copy, download, record, reproduce, sell, share, upload, distribute, adapt, or republish the course materials without written permission from NauticSense Learning.

Where downloadable materials are provided, they are for the learner’s own course-related use only unless clearly stated otherwise.

5. Intellectual Property

All course content, including text, videos, images, diagrams, learning activities, quizzes, downloadable materials, frameworks, branding, certificates, and course structure, belongs to NauticSense Learning or is used under licence.

This includes, but is not limited to:

  • NauticSense Learning branding;
  • NauticSense Start Strong™;
  • NauticSense Alignment Framework™;
  • PESP Check™;
  • course scripts;
  • assessment questions;
  • downloadable learner resources;
  • course structure and learning design;
  • certificate designs;
  • training guidance materials.

You are granted a limited, non-exclusive, non-transferable licence to access and use the course materials for your own learning or agreed internal training use.

You must not use NauticSense Learning materials to create, deliver, sell, support, or promote competing training products without written permission.

6. Acceptable Use

You agree not to:

  • misuse the website or course platform;
  • attempt to copy, scrape, extract, reverse-engineer, or reproduce course content;
  • share login details;
  • allow another person to complete the course using your account;
  • upload harmful, unlawful, misleading, offensive, or disruptive material;
  • interfere with the operation or security of the website or platform;
  • use the course materials for unlawful purposes;
  • misrepresent your completion status;
  • reproduce, amend, or misuse certificates;
  • attempt to bypass payment, access controls, or course restrictions.

7. Assessments and Certificates

Some courses may include quizzes, assessments, completion checks, reflective activities, or certificates.

A certificate confirms that the named learner has completed the relevant course requirements on the platform. It does not confirm competence to perform a specific operational task unless this is expressly stated.

A certificate does not replace employer competence assurance, vessel familiarisation, site induction, statutory training, task-specific instruction, or operational authorisation.

We reserve the right to withhold, remove, or correct certificates if completion data is inaccurate, fraudulent, incomplete, or affected by technical error.

8. Pricing and Payment

Course prices are shown at checkout.

Payment must be made through the payment options available on the website or course platform.

Access to paid courses will normally be provided once payment has been completed successfully.

We may change course prices, offers, discounts, or access arrangements from time to time. Price changes will not affect purchases already completed.

9. Refunds and Cancellation

If you are purchasing as a consumer, you may have statutory rights under UK consumer law.

Our courses are supplied as online digital content. Access to the course may begin immediately after purchase.

By purchasing and accessing the course, you acknowledge that course access can begin straight away. Where permitted by law, you may lose your statutory right to cancel once digital content has been supplied or accessed.

Our general refund position is:

  • if you have purchased a course but have not accessed the course content, you may contact us within 14 days of purchase to request a refund;
  • if you have accessed a substantial part of the course, completed assessments, downloaded materials, or received a certificate, refunds will not normally be provided unless required by law;
  • if there is a technical issue that prevents access, we will aim to resolve it within a reasonable time;
  • refunds will be reviewed fairly and in line with applicable consumer rights.

10. Business and Group Purchases

Where a company, employer, or organisation purchases access for one or more learners, the purchasing organisation is responsible for ensuring that learner details are accurate and that learners are authorised to access the course.

Unless agreed otherwise in writing, course access is for the named learner only and cannot be transferred after the learner has started the course.

Where an employer or organisation purchases or arranges access, relevant completion information may be shared with that employer or organisation where appropriate.

11. Course Availability and Platform Access

We aim to keep the course platform available, but we do not guarantee uninterrupted access.

Access may be affected by maintenance, updates, technical issues, internet service problems, payment issues, browser settings, device compatibility, or third-party platform disruption.

We may update, improve, replace, or remove course content where reasonably necessary.

12. Third-Party Platforms

Our courses may be hosted, supported, or delivered through third-party platforms, including Thinkific and payment providers.

Your use of those services may also be subject to their own terms, policies, privacy notices, payment rules, and technical requirements.

We are not responsible for issues caused by third-party platforms that are outside our reasonable control, but we will try to assist where possible.

13. Accuracy of Course Content

We make reasonable efforts to ensure our course content is accurate, practical, and suitable for professional learning.

However, maritime operations vary by vessel, company, location, role, equipment, operation, weather, regulatory environment, and company procedure.

Course content should be applied with professional judgement and in line with your own organisation’s procedures and legal duties.

14. No Operational Guarantee

NauticSense Learning courses are designed to support learning and professional awareness.

We do not guarantee that completing a course will prevent incidents, accidents, errors, losses, non-compliance, or operational failure.

The safe planning and execution of maritime work remains the responsibility of the relevant employer, duty holder, vessel operator, manager, supervisor, master, crew member, contractor, or competent person as applicable.

15. Limitation of Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

To the fullest extent permitted by law, NauticSense Learning will not be liable for indirect losses, loss of profit, loss of business, loss of opportunity, operational losses, reputational losses, or losses arising from misuse of the course materials.

Our total liability in connection with a course purchase will not normally exceed the amount paid for the relevant course, unless the law requires otherwise.

16. Suspension or Termination

We may suspend or terminate access if you breach these Terms, misuse the platform, share access, infringe intellectual property, misuse certificates, behave fraudulently, or use the course in a way that may harm NauticSense Learning or other users.

17. Privacy

How we collect, use, and protect personal information is explained in our Privacy Policy.

By using the website, creating an account, purchasing a course, or accessing course content, you acknowledge that personal information will be handled in accordance with our Privacy Policy.
